1. Validity

These conditions govern the sale and supply of products from AQUA SRL to you. AQUA SRL may change these conditions in the future. Any changes to the current conditions will be communicated by e-mail to registered users and will take effect immediately from the time they are posted on the site.

2. The contract between you and AQUA SRL.

There is no commitment between you and AQUA SRL until AQUA SRL has sent you an e-mail confirming receipt of your order and its acceptance. AQUA SRL has the right to withdraw from any commitment in the event of obvious errors or inaccuracies affecting the goods or orders appearing on the AQUA SRL site.

3. Prices and availability

The prices of AQUA SRL products are clearly indicated on the site and are inclusive of VAT. To the price of the product must be added the shipping cost, the amount of which varies depending on the quantity and weight of the total order, as well as the mode of delivery. Price and availability data shown on the AQUA SRL website are subject to change without notice, but the price indicated at the time of order applies to payment.

4. Delivery of products

AQUA SRL will deliver the ordered products to the address you have indicated during the order confirmation. All delivery times quoted on AQUA SRL are estimates based solely on normal order processing and delivery times stated by the carriers. The carriers used do not make advance phone calls or handle requests for shipments at particular times. Indicatively, without this entailing any constraints for AQUA SRL and except in the event of force majeure, the goods will be delivered by AQUA SRL to the carrier within 24 hours (working days).

5. Liability

AQUA SRL assumes no liability for inefficiencies attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that would prevent, in whole or in part, to give execution of the shipment in the time agreed by the contract. AQUA SRL shall not be liable to any party with respect to damages, losses and costs incurred as a result of the non-execution of the contract (for the aforementioned causes), the consumer being entitled only to a refund of the price paid. Likewise, AQUA SRL shall not be liable for any fraudulent and illegal use by third parties, of checks and other means of payment, when paying for the purchased products.

6. Right of withdrawal

The customer has the right to withdraw, without penalty, no later than 14 working days after delivery. Excluded from the legislative decree are persons not classifiable as consumers, i.e., those acting for purposes referable to the professional activity possibly carried out, i.e., VAT subjects requesting invoice. The right of withdrawal is exercised within the prescribed period, subject to a request for authorization to the e-mail address [email protected]. The return of clothing (including accessories) is allowed in case the products are defective or not in the size ordered. In these cases the service is free of charge and the return shipping costs are always borne by AQUA SRL. The products must not be used, must reach us intact, not worn or stained, must be in their original packaging, complete with labels and any other possible parts that make them up. Failure to comply with these principles renders the right of withdrawal inapplicable. We urge kind customers to cooperate with us by following our procedure for sending returns and not to send us goods for which the right of withdrawal does not apply. In the event of a return, the customer may request a refund via Discount Coupon or in cash. The issuance of the Discount Coupon occurs immediately after the conclusion of the return procedure and can be used within one year for a future purchase on AQUA SRL. In the case of money refund will be used the same method used for payment of the order: if the purchase was paid by Credit Card/Paypal account method the refund will be made directly to the card/account with which the payment was made, while if the order was paid by Cash on Delivery (COD) method, the refund will be made by bank transfer to the bank account provided by the customer. The issuance of the cash refund may take up to 14 days. Once the goods have been received and their condition has been verified, AQUA SRL will calculate the value of the refund and notify the customer. The value of the Discount Coupon is never refundable in cash. In the case of discounts derived from the use of Discount Coupons, we will handle the return as follows: In the case of products returned by the customer's free choice, the amount of the discount originally applied will be deducted in full from the value of the returned products. In case of defective products or mistakes made by AQUA SRL, if the returned product was affected by the Discount Coupon used for the order, only the discount component related to the product itself will be subtracted. This will be calculated proportionally using the formula: Discount / Amount of products affected by the Discount Coupon * Amount of returned products. For a cash refund, in the event that the shipment was originally discounted, if the amount of products returned due to defect or error of AQUA SRL added to the products remaining in the possession of the customer after the return, net of any residual discounts not previously deducted from the amount of products returned, no longer meets the conditions to be entitled to free shipping, the cost of shipping will be deducted from the amount of the refund. In the case of a voucher refund, any originally discounted shipping cost will never be subtracted from the refund amount. Please note: In the event that the right of withdrawal does not apply, the products will be held at our premises. It will be the customer's responsibility to arrange a shipment to pick up the goods at his or her expense.

7. Obligations of the purchaser

The consumer undertakes and is obliged, once the “online” purchase procedure is completed, to print and keep these general conditions, which, moreover, he will have already viewed and accepted at the time of registration and/or confirmation of the order.

  • 7.1 These general conditions may be updated or modified at any time by AQUA SRL, which will notify by e-mail. The consumer undertakes and obliges, whenever there is a change in these general conditions, to ensure that they are printed and preserved.
  • 7.2 It is strictly forbidden for the purchaser to enter false, and / or invented, and / or fantasy data during the purchase and registration process. The master data and e-mail must be exclusively one's own real personal data and not that of a third person, or fictitious. It is expressly forbidden to make double registrations corresponding to one person or to enter data of third persons. AQUA SRL reserves the right to prosecute any violation and abuse, in the interest and for the protection of all consumers.
  • 7.3 The customer shall hold AQUA SRL harmless from any liability arising from the issuance of erroneous tax documents due to errors relating to the data provided by the customer, the customer being solely responsible for their correct entry.
  • 7.4 In compliance with the regulations contained in art.3 paragraph 4 of law 15 July 2009 n. 94. it is forbidden to sell non-biodegradable sprays to minors under the age of 18. Since it is not possible for AQUA SRL to verify the truthfulness of the data sent to us and the real age of our customers, the buyer assumes full responsibility by implicitly declaring, through the confirmation of the order itself, that he/she has reached the age of majority.

8. Existing legislation and jurisdiction

Contracts between you and AQUA SRL shall be subject to Italian law and all disputes shall be under the jurisdiction of the Court of Bari.
